Supreme Court of Delaware

Evans v. State

August 7, 2015

Summary

The Supreme Court held that the Superior Court improperly treated Evans’s motion to correct an illegal sentence as a time-barred motion to reduce sentence. It nevertheless affirmed because the motion lacked merit: Evans’s knowing, intelligent, and voluntary guilty plea waived his double-jeopardy and multiplicity challenge to two possession-with-intent-to-deliver convictions.
