Summary

The Supreme Court of Delaware affirmed the denial of Mark Courtney’s motion to correct his sentence. Although probation for the relevant offenses is generally limited to two years, Courtney’s challenge concerned the manner in which his sentence was imposed and was filed more than ninety days after the violation-of-probation sentence. The Court found no exceptional circumstances warranting review and no Department of Correction application permitting consideration of the untimely claim.
