Summary
The Supreme Court of Delaware held that the Family Court could not transfer the Wife's interest in jointly titled property without addressing her continuing liability on the property's loan. Although the Family Court equitably calculated the Wife's share and ordered the Husband to buy her interest, it was required to address removal of the Wife's name from the loan because she would otherwise remain exposed to the Husband's late or missed payments. The matter was remanded for further proceedings limited to that issue.
