Supreme Court of Delaware

Brewer v. State

July 30, 2015

Summary

The Court affirmed the denial of Brewer’s second motion for postconviction relief. It held that the amended procedural rule required summary dismissal because Brewer had pleaded guilty rather than been convicted after trial, and that his knowing and voluntary plea independently foreclosed claims based on undisclosed forensic-laboratory misconduct and the reliability or admissibility of the State’s evidence. The Court also found no improper coercion or assertion of actual innocence that would undermine the plea.
