Summary

The Supreme Court of Delaware affirmed Tucker’s modified violation-of-probation sentence. It held that the Superior Court was not required to follow a probation officer’s sentencing recommendation and that the ninety-day Level V or Level IV VOP Center sentence was within the statutory limits.
