Summary

The Supreme Court of Delaware affirmed the summary denial of Summers's sixth motion for postconviction relief. Although Summers claimed that the admission of his statement violated his rights because the trial court did not examine whether he knowingly waived counsel, his claim was procedurally barred and did not satisfy the narrow miscarriage-of-justice exception. The record showed that Summers was informed of his right to counsel, did not invoke it, and gave an extensive statement, while he alleged no coercion or alteration of the recording or transcript.
