Summary

The Supreme Court of Delaware affirmed the summary dismissal of James St. Louis’s sixth postconviction motion. It held that he failed to plead with particularity either new evidence establishing a strong inference of actual innocence or a retroactive constitutional rule rendering his conviction invalid, and therefore was not entitled to appointment of counsel. The Court also cautioned that repetitive future motions may not receive further judicial attention.
