Supreme Court of Delaware

Matter of: Desmond

October 20, 2014

Summary

The Court dismissed Desmond’s petition for a writ of mandamus because it lacked jurisdiction to compel the Attorney General to honor an expired plea offer and, insofar as the petition sought relief against the Superior Court, Desmond had an adequate remedy through his pending appeal. The Court also deemed the repetitive petition legally frivolous and imposed prospective filing requirements and a warning concerning forfeiture of good time. No separate opinions were filed.
