The Supreme Court of Delaware affirmed the denial of Donald Bible’s second motion for postconviction relief. It held that the governing version of Rule 61 required summary dismissal of a successive motion because Bible was convicted after a guilty plea rather than a trial, so his claimed exception for a miscarriage of justice could not provide a basis for relitigation. The court therefore did not reach the merits of his ineffective-assistance allegations.
