Summary

The Supreme Court of Delaware affirmed the Family Court’s custody order granting the parents joint legal custody and giving the Mother primary residential placement. The Court held that it could not resolve factual matters raised for the first time on appeal, including why the Father failed to participate and whether the Mother was credible or the placement served the child’s best interests. Those matters had to be presented initially through a properly supported motion to reopen the default judgment under Rule 60(b).
