Supreme Court of Delaware

Allison v. State

December 10, 2014

Summary

The Supreme Court affirmed the denial of Allison’s motion to correct an allegedly illegal sentence. Although the Superior Court apparently treated the filing as an untimely sentence-reduction motion, the Supreme Court held that affirmance was proper because the motion lacked merit under the rule governing illegal sentences: separate sentences for first-degree robbery and possession of a firearm during the commission of a felony did not violate double jeopardy.
