Supreme Court of Delaware

Alley v. State

November 20, 2014

Summary

The Court affirmed the denial of Alley’s motion for post-conviction relief because the motion was filed outside the applicable one-year period and Alley failed to establish the prejudice required for a colorable ineffective-assistance claim that could overcome the procedural bar. Although the Court assumed counsel’s advice could satisfy the deficiency prong, it agreed that Alley suffered no actual prejudice.
