Summary
The Court held that the Hearing Officer had statutory authority to conduct Richardson’s disciplinary hearing and that the Board had authority to suspend his cosmetology license for leasing salon space to an unlicensed nail technician. The Court nevertheless reversed because the Board failed to create a record sufficient for appellate review of Richardson’s exceptions and remanded for a new on-the-record proceeding. The Court did not decide whether the Board actually considered Richardson’s exceptions because the remand would provide an opportunity for that consideration.
