Supreme Court of Delaware
Linda L. Thompson and Unemployment Insurance Appeal Board, Appellees Below, Appellants v. Christiana Care Health…
August 12, 20112011 Del. LEXIS 410
Summary
The Supreme Court of Delaware affirmed the Superior Court’s reversal of the Unemployment Insurance Appeal Board’s award of benefits to Linda Thompson. The Court held that an employee establishes good cause for voluntarily leaving employment only when the reason is attributable to the employer, would compel a reasonably prudent employee to leave, and follows exhaustion of reasonable alternatives; Thompson’s unpleasant workplace and unsuccessful transfer efforts did not satisfy that standard. The Court also held that Thompson did not adequately notify an authorized employer representative or allow sufficient time for corrective action.
