Supreme Court of Delaware

In Re Goldstein

March 15, 2010990 A.2d 404

Summary

The Court held that the respondent negligently violated his professional duties to the lender by failing to identify and explain that the lender's loan documents violated federal law. It also held that a lawyer representing an interested party in a residential real estate transaction must timely provide written disclosure and an opportunity for independent counsel when the borrower is unrepresented, even if the lawyer does not represent the borrower. The Court imposed a public reprimand, costs, and dissemination of the opinion.
