Supreme Court of Delaware
Edgar Velasquez, Defendant Below, Appellant v. State of Delaware, Plaintiff Below, Appellee
April 27, 20102010 Del. LEXIS 192
Summary
The Supreme Court of Delaware affirmed the denial of Velasquez's postconviction motion challenging his nolo contendere plea. Although the Spanish-language Truth-in-Sentencing form contained an apparent inconsistency and did not identify the ten-year minimum in the answer blank, the plea colloquy, signed plea documents, and sentencing range established that he understood the sentence would begin at ten years. The Superior Court therefore did not abuse its discretion in finding the plea knowing, voluntary, and intelligent.
