Summary
The court held that the plaintiff was entitled to mandatory treble damages for identity theft and could also recover discretionary punitive damages under CUTPA. The remedies were not duplicative because treble damages compensate for the plaintiff's losses, whereas CUTPA punitive damages punish and deter wrongful commercial conduct. The court therefore reversed the portion of the intermediate appellate judgment requiring vacatur of the punitive damages award and otherwise affirmed.
