Summary
The court affirmed the defendant’s conviction for possessing fifty or more visual depictions of child pornography. It held that at least eleven of thirteen challenged images depicted a lascivious exhibition and that the remaining challenged issues did not warrant reversal because the jury received a sufficient general unanimity instruction and the challenged exhibits were properly admitted. The court also clarified that the first five Dost factors may guide the lascivious-exhibition inquiry, but the sixth factor concerning a viewer’s sexual response should not be used in possession cases.
