The court held that a probate appeal is an action within the meaning of Practice Book § 17-44, so summary judgment may be available in such an appeal. The court nevertheless reversed because the Superior Court resolved only the appellant’s discovery allegations rather than independently deciding whether the trust required equal distribution of the remaining estate. On remand, the Superior Court must conduct the required de novo determination of the trust-distribution issue.
