Summary
The court held that the pension agreement did not require the town to make to retired officers the same health savings account contributions it made to active police officers. It concluded that HSA contributions are neither insurance coverage nor deductibles because they are separate funds that do not alter the insurance policy's risks or deductible amounts, and extrinsic evidence independently supported that interpretation. The court reversed and remanded with instructions to enter judgment for the town. Justice D’Auria, dissenting, would have treated the agreement as ambiguous and affirmed the judgment requiring the contributions.
