Supreme Court of Connecticut
Duso v. Groton — dissenting
December 9, 2025353 Conn. 667
Summary
Justice D’Auria dissented from the court’s conclusion that the pension agreement unambiguously excluded employer HSA contributions from retirees’ health-insurance benefits. She would find the agreement ambiguous but conclude that the retirees’ interpretation was more reasonable because the agreement broadly defined coverage and expressly linked the HSA contributions to payment of deductibles. She therefore would affirm the Appellate Court’s judgment. Justice D’Auria’s dissent contests the majority’s interpretation of the pension agreement and its treatment of HSA contributions.
