Summary
The court held that the defendant's prosecution on count two was barred by the applicable five-year statute of limitations because the 2020 substitute information introduced previously uncharged conduct occurring in 2014 at a different location. The timely informations gave notice only of charged conduct occurring in 2017, and the arrest warrant affidavit did not toll the limitations period for the uncharged 2014 conduct. The court therefore reversed as to count two, directed entry of an acquittal on that count, and ordered resentencing on the remaining counts.
