Summary
The court held that the defendant's prosecution on count two was barred by the applicable five-year statute of limitations because the 2020 substitute information first charged conduct allegedly occurring in 2014, more than five years earlier. The 2014 charge did not relate back to the timely informations, which concerned different conduct occurring in 2017 at a different location, and the arrest-warrant affidavit did not toll the limitations period for uncharged conduct. The court therefore reversed as to count two, directed an acquittal on that count, and ordered resentencing on the remaining counts.
