Summary
The court held that a custody order improperly delegated judicial authority by allowing the custodial father, after consulting the child’s therapist, to suspend or reinstate supervision of the mother’s visitation. Although a court may authorize reasonable scheduling adjustments, only the court may decide whether a parent retains visitation rights. The court reversed the challenged custody modification and remanded for further proceedings limited to that issue. Robinson, C.J., joined by Mullins, J., concurred in the judgment but would have permitted narrowly limited cancellation of individual visits when necessary to protect a child from harm.
