Summary

The court held that a trial court improperly delegated judicial authority by allowing a custodial parent, even after consultation with a therapist and a reasonable-impact determination, to suspend the other parent’s visitation indefinitely. Because only the court may modify a parent’s visitation rights under the governing custody statute, the court reversed the custody modification insofar as it authorized that delegation and remanded for further proceedings limited to the issue. Robinson, C. J., joined by Mullins, J., concurred in the judgment but would have permitted narrowly limited cancellation of an individual scheduled visit when necessary to protect a child from demonstrated potential harm.
