Summary
The court held that the defendant's appeal from the denial of summary judgment was immediately appealable because he raised a colorable collateral-estoppel claim. Exercising supervisory authority, the court nevertheless held that the pending probate appeal, which would be tried de novo, suspended the preclusive effect of the Probate Court's decree as to the undue-influence issue. The court reversed the Appellate Court and directed it to affirm the denial of summary judgment on the tortious-interference claim and remand for further proceedings.
