Supreme Court of Connecticut

Martinoli v. Stamford Police Dept.

December 24, 2024350 Conn. 868

Summary

The court held that an employee who sustains a compensable workplace injury remains eligible for total incapacity benefits even when the incapacity begins after voluntary retirement and the employee does not intend to return to work. Because the Appellate Court had rejected eligibility on those grounds without reaching two alternative claims by the defendants, the court reversed and remanded for consideration of those claims.
