Summary

The court affirmed summary judgment for the newspaper, holding that the plaintiff's passing references to an accompanying stock photograph did not distinctly plead an independent defamation claim and did not require the trial court to develop one on his behalf. The court also held that the fair report privilege applies when a publication provides a fair and substantially accurate account of official proceedings, and that malice in fact does not defeat that privilege. Justice Ecker, dissenting and joined by Justice D’Auria, would have required a more accommodating opportunity for the self-represented plaintiff to replead and cure the alleged defect.
