Summary

The court held that claims concerning negligent foundation design and construction were statutory claims sounding in tort and were barred by the three-year limitation period. It held separately that claims alleging breach of contractual obligations in the bylaws to maintain, repair, or replace common elements were governed by the six-year contract limitation period and accrued when the association ceased its repair efforts. The judgment was therefore affirmed in part and reversed in part. No separate opinions were filed.
