Summary

The court held that the special act authorizing the defendants to pursue an otherwise untimely claim against the state was an unconstitutional public emolument under the state constitution. Although the act identified public purposes, it benefited only these defendants, remedied a procedural default for which the state was not responsible, and did not provide comparable relief to similarly situated claimants. The court therefore affirmed the judgment upholding summary judgment for the state.
