Supreme Court of Connecticut
Reserve Realty, LLC v. Windemere Reserve, LLC
April 4, 2023346 Conn. 391
Summary
The court held that the commercial real estate listing agreements satisfied the statutory requirement to state the duration of the brokerage authorization because their duration was measurable from specified triggering events, even though the precise expiration date was not known when the agreements were executed. Nevertheless, the agreements were personal service contracts requiring the named broker's personal performance and therefore terminated upon her death. Because no commission-generating sale or lease occurred during her lifetime, the defendants were not liable for brokerage commissions. No separate opinions were issued.
