Summary
The court held that Executive Order No. 7V immunizes health-care providers only for good-faith acts or omissions connected to services supporting the state's COVID-19 response, and that the connection ended when the decedent's COVID-19 test was reported negative. It further held that the PREP Act did not immunize the alleged negligence or gross negligence because the claims concerned misdiagnosis and delayed cardiac treatment rather than improper administration or use of the COVID-19 test. The court therefore reversed dismissal of the gross-negligence counts, affirmed the remaining rulings, and remanded for further proceedings.
