Summary
The court held that the executive-order immunity was not limited to care involving COVID-19 patients, but required a direct connection between the alleged acts or omissions and a specific pandemic-related lack of resources. Because the defendants showed pandemic-related resource shortages but did not show that those shortages caused the alleged failures in the decedent’s care, the immunity issue remained factually disputed and could not be resolved on a motion to dismiss. The denial of the motion to dismiss was therefore affirmed.
