Summary
The court held that the state executive-order immunity covered good-faith medical acts connected to the state’s COVID-19 response before the decedent’s negative test result, but not care provided after COVID-19 was ruled out. It further held that the federal PREP Act did not immunize the pleaded negligence and gross-negligence claims because the alleged misconduct concerned diagnostic and treatment decisions, not the administration or use of the COVID-19 test itself. The judgment was therefore reversed in part and affirmed in all other respects.
