Summary

The court held that discretionary-act governmental immunity does not bar negligence claims arising from the manner in which a police officer operates an emergency vehicle under the statutory emergency-vehicle privileges. The statutory duty to drive with due regard for the safety of persons and property operates through the savings clause in the governmental-immunity statute and preserves liability for negligent operation. The court therefore reversed summary judgment for the defendants and remanded for further proceedings.
