Summary
The court held that the defendant’s site work was excluded from the Home Improvement Act because it constituted part of the construction of a new home. Although the plaintiff separately contracted for the site work, that work was contemplated by the general home-construction agreement, was dependent on and coordinated with construction of the house, and was substantially related to habitability and zoning compliance. The court therefore affirmed the Appellate Court’s judgment rejecting the Home Improvement Act and derivative CUTPA claims.
