Summary

The court held that the defendant's site work fell within the Home Improvement Act's exception for construction of a new home. Although the plaintiff separately contracted with the defendant, the work was part of the construction contemplated by the principal homebuilding contract, was physically and temporally interrelated with that construction, and contributed to the home's habitability and zoning compliance. The court therefore affirmed the Appellate Court's judgment rejecting the Home Improvement Act and related CUTPA claims.
