Supreme Court of Connecticut
State v. Pan (Order on Motion)
November 29, 2022
Summary
The court upheld the $20 million bond as a reasonable exercise of the trial court's discretion given the defendant's extraordinary flight risk, the seriousness of the charged homicide, and evidence of evasive conduct and financial resources. It nevertheless remanded because the trial court incorrectly concluded that it lacked authority to consider a 10 percent cash-bail option for a bond exceeding $20,000. The court also established procedures for future bond-modification hearings involving alleged unaffordability, including allocation of burdens, a preponderance standard for the state, de novo review by the trial court, and enhanced findings.
