Supreme Court of Connecticut

Peek v. Manchester Memorial Hospital

February 2, 2022342 Conn. 103

Summary

The court held that the statute of limitations for the plaintiff's negligence action began when she knew or reasonably should have known both that she suffered physical harm and that the defendants' negligence caused it. Because the plaintiff's evidence could support a finding that she did not learn of that causal connection until April 6, 2015, a genuine issue of material fact existed as to whether her action was timely. The court therefore affirmed the Appellate Court's reversal of summary judgment.
