Supreme Court of Connecticut

High Ridge Real Estate Owner, LLC v. Board of Representatives

March 15, 2022342 Conn. 423

Summary

The court held that the Board of Representatives lacked authority under the Stamford Charter to determine the validity of a protest petition; that responsibility belonged to the Zoning Board before referral. The court nevertheless held that the petition was valid because the charter required a number of landowner signatures, not a number of parcels, and the petition contained at least 360 qualifying signatures. The judgment was reversed and remanded for consideration of the plaintiff's remaining challenge to the merits of the zoning amendment.
