Summary

The court held that the trial court abused its discretion by ordering permanent alimony of $18,000 per month that was nonmodifiable as to both duration and amount without adequately considering the payor's age, health, future earning capacity, and the possibility of changed circumstances. It also held that awarding the plaintiff a share of the businesses' value and alimony based on actual income from those businesses was not impermissible double counting, although the overall financial orders must remain fair and equitable. The court therefore affirmed the reversal of the financial orders in part, reversed the double-counting ruling, and remanded for a new hearing on all financial issues.
