Supreme Court of Connecticut

Ledyard v. WMS Gaming, Inc.

April 21, 2021338 Conn. 687

Summary

The court held that the statutory authorization for municipalities to recover reasonable attorney's fees incurred as a result of and directly related to delinquent personal-property-tax collection proceedings can include fees from a related federal action. Because the federal action was filed after the state collection action, challenged the municipality's authority to pursue that action, and was determinative of it, the fees were recoverable under the statute. The court reversed the Appellate Court and directed it to affirm the trial court's judgment.
