Supreme Court of Connecticut

Gallagher v. Fairfield

July 28, 2021339 Conn. 801

Summary

The court held that the 1985 collective bargaining agreement did not prevent Fairfield from replacing the plaintiff's private retiree health insurance with Medicare and supplemental coverage, provided that substantially similar benefits were furnished. It also held that the town was not required to reimburse Medicare Part B premiums because the plaintiff conceded that retirees could be required to contribute the same amount as active employees, and the evidence showed that he was not paying more. The court declined to consider the plaintiff's separate challenge to the manner of his enrollment because the record was inadequate and the claim was inadequately briefed.
