The court held that the property owner had not waived its challenge to the Sunday-racing prohibition because the prior stipulated judgments operated prospectively as injunctions subject to modification and did not permanently bind successors. It further held that the state racing statute did not preempt the town’s more restrictive Sunday ban, that “weekday” in the zoning amendments included Saturday, that the unmufflered-racing restrictions were not municipal noise-control ordinances requiring state approval, and that the special-permit and site-plan prerequisite for seeking regulatory amendments was invalid because it arbitrarily restricted who could seek an amendment. The judgment was therefore affirmed in part and reversed in part.
