Summary

The court upheld the plaintiff's ability to challenge the Sunday-racing prohibition, but held that the state racing statute did not preempt the town's more restrictive zoning regulation. It also held that the zoning amendments allowed mufflered racing on Saturdays, that the restrictions on unmufflered racing were not municipal noise-control ordinances requiring state approval, and that the commission could not condition a petition to amend the regulations on obtaining a special permit and site plan. The judgment was therefore affirmed in part and reversed and remanded in part on those specific issues.
