Supreme Court of Connecticut
Jenzack Partners, LLC v. Stoneridge Associates, LLC
January 14, 2020334 Conn. 374
Summary
The court held that the plaintiff had standing to foreclose the mortgage because the guarantee expressly extended to future holders of the note, and assignment of the note therefore carried the guarantee with it. The court also held that the plaintiff's debt calculation, including an initial balance supplied by the original lender, was admissible under the business-records exception because the original lender had a business duty to provide accurate information and the plaintiff incorporated that information into its own records. The court reversed the Appellate Court in part and directed judgment affirming the trial court's foreclosure judgment.
