Summary
The court held that the plaintiffs were not required to exhaust administrative remedies because their complaint alleged common-law negligent hiring and supervision, rather than seeking relief for denial of a free appropriate public education. It also held that the local board of education and its members were not protected by sovereign immunity because the alleged misconduct concerned execution of a school program under municipal control, not the design or establishment of a state educational program. The dismissal was therefore reversed in part and remanded for further proceedings.
