Summary

The court held that the estate representatives could be substituted for the deceased defendant because the plaintiff’s fraud-based motion to open remained pending when he died. Opening the dissolution judgment solely to reconsider allegedly fraudulent financial orders would not reinstate the marriage, so the proceeding was neither defeated nor rendered useless by the defendant’s death. The court therefore reversed the denial of substitution and remanded for further proceedings.
