Summary

The court held that the statutory waiver of sovereign immunity for negligence involving a state-owned and insured motor vehicle extends to state employees, so the trial court had subject matter jurisdiction. It nevertheless held that workers’ compensation exclusivity barred the plaintiff’s tort claim because the waiver did not eliminate the state’s defense under the workers’ compensation statute. The judgment was reversed because the trial court used the wrong procedural form, and the case was remanded for judgment in favor of the state.
