Summary

The court affirmed the Appellate Court's conclusion that the trial court improperly expedited and decided a stipulated-judgment modification without providing the public with accurate notice of the hearing date. Although trial courts generally have discretion to schedule short-calendar matters in less than five days, that discretion is limited when environmental-intervention statutes require prospective intervenors to receive timely, accurate notice. The court adopted the Appellate Court's reasoning except for its conclusion that the five-day scheduling rule itself was violated.
